Marital Agreements


Prenuptial agreements—also called premarital agreements or antenuptial agreements—are written contracts between prospective spouses made in contemplation of marriage and to be effective upon marriage.

Postnuptial agreements are written contracts entered into after the marriage has taken place. A postnuptial agreement serves the same purpose as a prenuptial agreement, with the only difference being when the agreement was created. Individuals who are contemplating separation or divorce may make a postnuptial agreement, also known as a separation agreement, marital settlement agreement, or property settlement agreement.
