Custody decisions dictate with whom the children will live and the amount of time each parent will spend with the children, as well as who is responsible for making decisions about the children. Physical custody refers to the amount of time that each parent is permitted to physically be with the child. Legal custody refers to the amount of involvement a parent has in making decisions related to a child’s health, education, religion, and welfare. The legal standard to determine both physical and legal custody is the best interest of the child standard.
