Appeals


Family law cases decided by a Circuit Court can be appealed to the Court of Special Appeals. An appeal is not an opportunity to re-try the case; it is an opportunity to have the original ruling reviewed by a higher court. The standard used to review the case varies but in family law, common standards of review are abuse of discretion and clear error. The appellate system gives a great deal of deference to the trial court judge; as such it is unusual, although not impossible, to overturn a family law case.
